Terms of Service

These Terms of Service ("Terms") govern your access to and use of TrendPDF ("Service"), operated by Julian Lassen ("Operator"), Schlesische Straße 5, 10097 Berlin, Germany. By creating an account or using the Service, you agree to these Terms.
1. Service Description
TrendPDF is a SaaS platform that helps digital product creators identify trending YouTube topics and generate PDF-based digital products (e.g. guides, lead magnets, ebooks). The Service uses the YouTube Data API v3 to surface publicly available trend data.
2. Eligibility
You must be at least 18 years old to use this Service. By agreeing to these Terms you represent that you meet this requirement and have the legal capacity to enter into a binding contract.
3. Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at julian@trendpdf.net if you suspect unauthorized access.
4. Subscriptions, Top-Up Packs & Billing
TrendPDF offers a monthly subscription plan billed through Stripe. Prices are displayed in EUR (Euro) at checkout and are exclusive of any applicable taxes. Each subscription plan includes a defined monthly PDF generation allowance as stated on the pricing page.
In addition to subscriptions, you may purchase Top-Up Packs as one-time payments. Top-Up Packs add a fixed number of additional PDF generations to your account and do not expire. They are non-refundable once used.
Subscriptions renew automatically at the end of each billing period. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period. If you experience a verified technical failure preventing access to core features for more than 72 consecutive hours, you may contact julian@trendpdf.net to request a proportional credit — this is our sole remedy for service interruptions.
PDF generation and all features require an active paid subscription.
5. Right of Withdrawal (EU Consumers)
EU consumers have a statutory 14-day right of withdrawal from digital service contracts. However, by starting to use the Service immediately after purchase (e.g. generating your first PDF), you expressly consent to performance beginning before the withdrawal period expires and acknowledge that your right of withdrawal is thereby extinguished (§356 Abs. 5 BGB).
Top-Up Packs are one-time digital purchases. By purchasing a Top-Up Pack and having the credits added to your account immediately, you expressly consent to immediate performance and acknowledge that your right of withdrawal is extinguished upon delivery.
If you have not yet used any paid features, you may request a full refund within 14 days of your first payment by emailing julian@trendpdf.net.
6. Acceptable Use
You agree not to:
- Circumvent, reverse-engineer, or abuse the Service or its APIs.
- Use the Service to generate content that violates any applicable law.
- Share or resell your TrendPDF account credentials or subscription access with third parties.
- Scrape, cache, or store YouTube data retrieved through TrendPDF in violation of the YouTube Terms of Service.
- Attempt to overload, disrupt, or interfere with the Service's infrastructure.
- Use AI-generated outreach emails to send unsolicited bulk messages (spam) in violation of applicable anti-spam laws, including the German UWG, EU Directive 2002/58/EC, or CAN-SPAM. You are solely responsible for compliance with email marketing regulations in your jurisdiction, including obtaining valid consent from recipients where required.
7. YouTube API Compliance
The Service accesses YouTube data via the YouTube Data API v3. Your use of trend data displayed by TrendPDF is also subject to the YouTube Terms of Service and Google's Privacy Policy. We do not store or redistribute YouTube content beyond what is permitted by the YouTube API Services Terms of Service.
8. Intellectual Property & Commercial Use License
The Service, its UI, branding, and codebase are owned by the Operator. You retain full ownership of any PDF content you generate using the Service.
We grant you a worldwide, royalty-free, perpetual license to use, copy, adapt, publish, distribute, and sell any PDF content you generate through the Service for any personal or commercial purpose — including selling generated PDFs as digital products, lead magnets, ebooks, or any other commercial format. This commercial use right is the core intended use of TrendPDF.
By using the Service, you grant us a limited, non-exclusive license to process your inputs solely to deliver the Service to you. We do not use your content to train AI models. PDF generation uses third-party AI services (Anthropic, Inc.). Content generation is subject to Anthropic's usage policies; use of the Service constitutes acceptance of those policies.
9. AI-Generated Content — No Professional Advice
PDFs generated through TrendPDF are created by artificial intelligence based on publicly available information. All content is provided for informational and educational purposes only.
Nothing in any AI-generated PDF constitutes medical, therapeutic, clinical, legal, financial, nutritional, or professional advice of any kind. Content related to health, wellness, fitness, mental health, or medical topics does not replace consultation with a qualified healthcare provider, physician, or licensed professional.
Users acknowledge that AI-generated content may contain inaccuracies, outdated information, or errors. The Operator makes no representation that any content is complete, accurate, or suitable for any particular purpose.
10. Reseller Responsibilities & Distribution Liability
The commercial use license granted in §8 includes the right to resell, distribute, and monetize generated PDFs. As a reseller or distributor of generated content, you take on full legal responsibility for that content and its representation to end customers.
You are solely responsible for: (a) the accuracy and completeness of content you sell or distribute; (b) any claims you make about that content in your marketing or sales materials; (c) compliance with consumer protection laws in your jurisdiction, including mandatory disclosure that content is AI-generated where required by law; (d) ensuring your customers are informed that the content does not constitute professional advice.
You must not make false, misleading, or unsubstantiated claims about AI-generated content — including but not limited to: claims of medical efficacy, guaranteed outcomes, professional endorsements, or certifications not actually present in the content.
The Operator bears no liability for any claims, refund demands, regulatory actions, or legal proceedings arising from your commercialization of generated content. You agree to indemnify and hold harmless the Operator from any such third-party claims.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that trend data is complete, accurate, or up to date. YouTube API availability is outside our control.
12. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit or data, even if advised of the possibility.
Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence, as required by German law.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
For disputes with consumers within the EU, mandatory consumer protection provisions of the consumer's country of residence apply in addition to German law.
Exclusive jurisdiction for disputes with business customers is Berlin, Germany.
14. Changes to These Terms
We may update these Terms to reflect changes to the Service or applicable law. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.
